Footytees Submission Legal Terms & Conditions

By submitting your Design (hereinafter the "Design") and in consideration of Footytees.com evaluating your Design for its possible use, you agree to the following terms and conditions ("Design Submission Terms and Conditions"):

If your Design is selected, Footytees.com may use your Design in any manner, including but not limited to: reproducing the Design on apparel and other products, and, changing or reworking the Design by making color or size changes, making derivative works of the Design, using the Design on both the Footytees.com website and on promotional material for Footytees.com.

If your Design is selected, you agree that the designs submitted will be provided exclusively to footytees for a period of 180 days for sale on Footytees merchandise.

a. The 180 day period will begin from the first day of live posting on the website.

b. Communication of the designs for promotion (via weblogs, newsletters, Social Media etc) is allowed and encouraged, provided links to the Footytees site are made.

c. After the expiry of 180 days, you may use the design for any other purpose.

You represent and warrant that, the designs provided are your own original work, has not been previously published, and does not contain any trademarks, logos, copyrighted material, or any other intellectual property belonging to any third party: and accept all legal consequences if this is later found not to be the case.

You acknowledge that Footytees.com reserves the right to decline to select a Design for consideration for any reason, including poor design.

If your Design is selected for use by Footytees.com you will receive:

1. A variable commission per sale per design

2. With several popular designs you are given a spot in our 'Designers' section, complete with bio and link to your own website.

If your Design is selected, Footytees.com agrees to pay you according to sales over a 3 month period of products bearing your designs.

a. Sales   Designers Income (per sale)

1-50        € 2.00

51-99      € 3.00

100+      € 4.00

b. Earned commissions are processed at the end of the calendar quarter and will be paid within 7 days after the end of the quarter.

c. Payments will be made 4 times per year, in April, July, October and January. If the payment day falls on a weekend or public holiday, then processing will begin on the following business day.

d. To receive a payout, you must have accumulated at least €25 in earned commission and have provided valid bank or PayPal details. You alone will be responsible for the payment of any tax that arises as a result of receiving payment from Footytees.com

e. The payment amounts stated above are valid for a 3 month period beginning as of contract signature date. The payment amounts may be revised, with 1 month's notice to designers.

The decisions of Footytees.com are final and binding.
